Puerto Rico Coverage & ICHRA — Internal CSM Talking Points

Puerto Rico is not part of the federal ACA Health Insurance Marketplace, so there is no local source of “ACA-qualified health plans” the way ICHRA is designed to use in the 50 states. A standard ICHRA reimbursement model should not be presented as a turnkey solution for Puerto Rico-based employees. They need a separate benefit option, and the employer's broker needs to be able to support placing coverage in Puerto Rico.

Why ICHRA Doesn't Translate Cleanly to Puerto Rico
  • Puerto Rico residents cannot enroll through Healthcare.gov or the federal Marketplace, and are not eligible for premium tax credits — U.S. territories are excluded from the ACA Marketplace and APTC framework.
  • Puerto Rico does have its own individual and group health insurance market, regulated locally by Puerto Rico's Oficina del Comisionado de Seguros (OCS) under the island's own Health Insurance Code — but these are not “ACA-qualified” Marketplace plans, and ICHRA's design assumes access to Marketplace-referenced plans.
  • Because of this, reimbursing a Puerto Rico-based employee through ICHRA doesn't reliably connect them to a plan the way it does for employees in the states.
  • Puerto Rico-based employees generally need a separate benefit option outside the standard ICHRA / Marketplace model — for example, a locally issued group or individual medical plan through a Puerto Rico-licensed carrier.
  • The employer's broker must be licensed/appointed to place coverage in Puerto Rico and willing to support this separate arrangement. If they aren't, flag that as a blocker early.
  • Don't assume the standard benefitbay shopping/enrollment experience applies unmodified to Puerto Rico employees.
  • Flag any employee with a Puerto Rico residence or worksite for compliance review before modeling contributions or enrolling — the same protocol we use for Hawaii.
  • Confirm with the employer's broker, in writing, whether they support placing coverage in Puerto Rico before committing to an enrollment timeline.
  • “Puerto Rico isn't part of the federal ACA Marketplace, so we handle employees based there differently than employees in the states.”
  • “Your employee in Puerto Rico will need a separate benefit option — we'll need your broker to confirm they can place coverage there.”

This guidance is based on general regulatory research confirming Puerto Rico has no federal ACA Marketplace access or premium tax credits. It has not gone through the same depth of internal legal/compliance review as the Hawaii guidance. Treat any Puerto Rico case as an escalation, and confirm specifics with compliance/legal before finalizing standard language.
